Until Monday in Michigan, the line on abortion rights was clear. The state has a 1931 law criminalizing abortion that was dormant at the time Rua v. Wade. In May, a month before the Dobbs decision, a lower state court struck down the 1931 law, so it was not in effect when the US Supreme Court overturned Rua v. Wade.

On Monday, the Michigan Court of Appeals issued a ruling saying that an injunction does not apply to county prosecutors – so they could enforce the 1931 abortion ban. But because the decision appears to be ineffective for 21 days, it allows time to file appeals.

People in the state can still have access to abortion in the state, but it’s a confusing time and some abortion providers aren’t entirely sure what the legal status of things is.

Primary school for governor on Tuesday

Background to the gubernatorial primary that Tuesday in Michigan, where Republican candidates are fighting each other for the opportunity to face Democratic Gov. Gretchen Whitmer in November.

All five candidates are against abortion rights and all five support the state’s 1931 law that criminalizes abortion. That includes Tudor Dixon. Former President Donald Trump endorsed her on Friday night. She was also endorsed by Right to Life Michigan – a huge success in Michigan Republican politics.

State constitutional amendment

A ballot campaign is also underway in Michigan to enshrine abortion rights in the state constitution. Last month the group supporting the amendment, Reproductive Freedom for All, achieved a record number of signatures – more than 750,000.

If that question makes it onto the November ballot, voters will of course be voting for Governor, but they would then be voting on the future of abortion rights in Michigan. That could greatly affect the number of voters in the state.
